PARK RULES
1.General provisions
These rules (hereinafter referred to as the Rules) regulate the Bygailių Amusement Park, which belongs to the company MB ,,BYGAILIŲ PRAMOGOS“ įm.k. 307213096 (hereinafter referred to as the Park) and the territory adjacent to the Park, the procedure for servicing visitors and using and behaving in the Park, mandatory safety, hygiene and other requirements for visitors, their rights, duties and limits of liability, as well as the rights and duties of the Park operator (hereinafter referred to as the Operator). The Park rules have been drawn up in order to ensure a pleasant stay and good mood for each visitor in the Park and to avoid unpleasant misunderstandings, injuries or other losses.
1.1. A visitor to the Park is any person in the Park who has purchased a ticket, received a permit or entered the Park in another manner determined by the Operator (hereinafter referred to as the Visitor). The legal relations between the Visitor and the Operator are governed by these Rules and applicable legal acts.
1.2. The Operator grants the Visitor the right to stay and have fun in the Park only in accordance with the provisions of the Rules. Each Visitor, having purchased a ticket and entering the Park, automatically confirms that he/she is familiar with the internal rules of the Park and undertakes to unconditionally comply with them.
1.3. The Rules are not an offer (offer) by the Operator to conclude a contract. The Visitor's action when he/she familiarizes himself/herself with these Rules by signing is an offer (offer) to conclude a Contract on such terms. In turn, the action when the Operator or his/her authorized person issues a control bracelet (hereinafter referred to as the Bracelet) to the Visitor is recognized as acceptance. The Bracelet is put on the hand by the Employee himself/herself, in such a way that the Bracelet does not interfere with the Visitor's entertainment. The Operator or his/her authorized person is not obliged to accept the submitted offer (offer). These Rules and other circumstances cannot be considered an instruction or confirmation that the offer (offer) expressed by the Visitor will be accepted. The moment of conclusion of the Contract (hereinafter referred to as the Contract) is considered the moment when the Bracelet is issued to the Visitor.
1.4. For persons under 18 years of age, the Agreement is concluded and signed by a legal representative (parents, guardians, etc.) on the list of persons familiar with the Rules. This representative is fully responsible for the accompanied person under 18 years of age, including, but not limited to, responsibility for material and non-material damage caused to the accompanied person and the accompanied person, the health and safety of the accompanied person.
1.5. Persons over the age of 18 shall conclude the Agreement and familiarize themselves with the Rules. A person under the age of 18 shall be acquainted with the Rules by a legal representative (parent, guardian, etc.), expressing consent to conclude the Agreement shall be signed by the legal representative (parents, guardians, etc.) or a consent signed by a representative in the form established by the Operator shall be submitted.
1.6. The Visitor must wear the bracelet on his/her arm throughout the entire visit to the Park. A Visitor who does not have the bracelet on his/her arm is not allowed to use the attractions.
1.7. The Agreement is valid from the moment of its conclusion until the end of the same working day of the Park, regardless of the time of day the Agreement was concluded. The Visitor has the right to use the entertainment available in the Park only during the validity of the Agreement.
1.8. The Operator has the right to refuse to conclude the Agreement, as well as to unilaterally terminate the Agreement if the Visitor fails to comply with any of the requirements of these Rules.
1.9. Persons who have not concluded the Agreement or after the Agreement has expired do not have the right to use the Park's attractions.
1.10. The obligations established in these Rules also apply to those persons who enter the territory of the Park or for any reason use the entertainments available in the Park without concluding a Contract, having concluded the Contract incorrectly and/or after the expiration of the term of validity of the Contract. Nevertheless, a person who has not concluded the Contract acts at his own risk. Physical presence in the territory of the Park means familiarization with the Rules and agreement with the provisions of the Rules
1.11. Entertaining in the Park is permitted only after familiarizing yourself with these Rules.
General safety rules
2.1. The following attractions are available in the park:
2.1.1. Attraction "Ferris Wheel".
2.1.2. Attraction "Swans".
2.1.3. Horror zone, horror house.
2.2. When using all the entertainment listed in paragraph 2.1 of the Rules, the Visitor is subject to the following general safety rules:
2.2.1. Children under 18 years of age and persons with disabilities have the right to visit the Park only when accompanied by adult persons supervising them, who, together with the persons supervised by them, are responsible for compliance with these Rules. One adult may accompany no more than 10 children at a time.
2.2.2. The Visitor must comply with the verbal requirements and instructions of the Operator's employees and supervisors.
2.2.3. Park staff and employees are not considered persons accompanying and supervising minors in the context of these Rules. Park staff and employees do not supervise minors, but monitor the general order in the Park and compliance with these Rules.
2.2.4. The Visitor must immediately notify the Park staff of any accident that occurs in the Park, as well as any observed inventory malfunction.
2.2.5. The Visitor undertakes to follow the instructions of the Operator's personnel regarding safety requirements and compliance with these Rules in the Park.
2.2.6. Due to technical obstacles or bad weather conditions, the use of certain services in the Amusement Park may be temporarily prohibited. In such a case, the ticket price will not be recalculated and the money will not be refunded to the visitor.
2.2.7. In case of any uncertainty, the Visitor must not take any action and immediately contact the Park staff member nearby, and if the Park staff member is not nearby, ask the Visitors nearby to call the employee responsible for the Park staff. In case of any uncertainty, the Visitor has no right to take any action without the permission/instruction of the staff.
2.2.8. The Visitor must behave in a manner that does not pose a danger or cause harm to themselves, others, or the Operator.
2.2.9. The visitor must be dressed in clothing that does not interfere with or pose a danger during entertainment.
2.3. It is strictly forbidden in the park to:
2.3.1. use the Park's services while wearing inappropriate clothing (e.g. underwear) or without clothing; It is prohibited to have objects that may fall out, as well as sharp objects, with you while having fun;
2.3.2. scream, whistle, mislead the Park staff by calling for help without reason, push, run (the Visitor may slip and get injured);
2.3.3. to entertain while intoxicated by alcohol or other psychoactive substances;
2.3.4. to entertain persons with health problems whose illnesses may be aggravated by using the amusements available in the Park (adrenaline, physical activity, etc.). The implementation of this provision in relation to a Visitor under the age of 18 is ensured by the Visitor accompanying him/her;
2.3.5. walking around the territory of a specific attraction, except when using that attraction, climbing on an attraction mechanism, climbing structures or otherwise damaging the inventory in the Park;
2.3.6. perform natural functions outside the toilet;
2.3.7. leaving children under 18 years of age without adult supervision
2.3.8. consume alcoholic beverages and smoke;
2.3.9. bring alcoholic beverages, as well as glass, breakable and sharp objects to the Park;
2.3.10. push, make noise, behave rudely and disrespectfully, or interfere with other Visitors from using the Park's services;
2.4. It is strictly forbidden to visit the park:
2.4.1. persons suffering from infectious, viral or other contagious diseases, as well as persons with open wounds and/or other health conditions that may pose a risk to the health and/or life of the person themselves or other Visitors;
2.4.2. persons intoxicated by alcohol, narcotics or psychotropic substances. The amusement park staff has the right to demand a person's alcohol test (maximum permitted level - 0.4 per mille) and ask an intoxicated visitor to leave the Park without compensating for the paid entrance fee;
2.4.3. taking into account the health status of Visitors, persons with weak health (heart disease, head injuries, various bone fractures, spinal fractures or other diseases related to a person's physical, mental or moral condition) must not use attractions and horror rooms, as this may lead to negative consequences;
2.5. The visitor has the right to:
2.5.1. require that the responsible Park employee familiarize himself with these Rules before
When a visitor starts using the services provided by the Park;
2.5.2. use the Park's services only after paying the fee for visiting this Park or acquiring the right to use the services provided in the Park in other ways established by the Operator.
2.6. The Operator has the right to:
2.6.1. to prevent persons whose behavior may disrupt the order of the Park or pose a danger to others from entering the Park
The safety of visitors, the hygienic condition of the Park and/or would contradict socially accepted norms of behavior;
2.6.2. to deny entry to persons into the Park if they do not agree to comply with or do not understand these Rules;
2.6.3. change the list of services provided in the Park and/or their prices at any time without prior notice;
2.6.4. remove visitors from the Park who violate the Park rules or behave unsafely in the Park.
In this case, the money will not be refunded to the Visitors.
Rules for using the Park's attractions:
3.1. When using all the entertainment listed in paragraph 2.1 of the Rules, the Visitor must comply with the rules listed below.
3.2. The Visitor must familiarize himself with the warning signs placed in the Park in advance and strictly follow them; If the Visitor has any questions or uncertainties, he must contact an employee of the Operator and ask for all necessary information.
3.3. The park's attractions can be used by persons of the recommended age;
3.4. Only those persons who are familiar with the rules and strictly adhere to them have the right to use the park's attractions.
3.5. Visitors are strictly prohibited from performing actions that contradict the Rules.
3.6. The visitor must be focused on the safe use of the Park's inventory.
3.7. A Visitor has the right to enjoy entertainment only in designated areas and only when he is completely sure that there are no obstacles or other Visitors on his path or at the landing site, and only if the supervisor has given permission to use the entertainment.
3.8. The Visitor must maintain a safe distance from the Visitors in front and avoid collisions with other Visitors. It is strictly forbidden to collide with other Visitors. The Visitor is responsible for collisions with other Visitors and for the consequences of the collision if he did not maintain a safe distance or performed jumps and other movements without making sure that there are no obstacles or other Visitors in his path. It is forbidden to stop completely and stand at the landing site, unless this is objectively unavoidable.
3.9. The visitor must choose the Park's attractions according to their skills and physical ability.
3.10. The Visitor is fully responsible for his/her health and life, and is responsible for ensuring that the chosen descent speed, movement trajectory, and body position correspond to the Visitor's skill level and do not pose a threat to other Park Visitors.
3.11. Visitors are prohibited from putting their hands or feet on the handles or springs, carousel mechanisms, hanging from them or using them in other ways other than for their intended purpose.
3.12. The visitor must stop or leave the entertainment/attractions if they feel tired, injured, overheated in the sun, or for other reasons doubt their strength or health.
3.13 There can be as many Visitors on one attraction at a time as there are seats.
3.14. The visitor must not have suffered neck injuries or trauma, have heart problems or blood pressure problems, have not strained or pulled tendons, have not suffered arm or shoulder fractures; have not suffered back, neck, bone or muscle injuries or problems and have not had any other disorders.
3.15. Pregnant women are prohibited from using the entertainment.
3.16. It is prohibited to land on the head or in any other way that would endanger the health or life of the Visitor and other Visitors.
3.17. Children under the age of 18 may only have fun under the continuous supervision of parents or other accompanying persons, who are fully responsible for the children, including, but not limited to, responsibility for the child and any material and non-material damage caused to the child, as well as the child's health and safety.
3.18. Before leaving a child under the age of 18 in the Amusement Park, the person responsible for him/her must sign a contract, in which it is necessary to indicate the child's name, surname, age and his/her telephone number. The person responsible for the child guarantees that the information provided in the Contract is correct and assumes full responsibility for providing false information. Leaving a child in the Park is allowed only after the person responsible for the child has carefully read the Rules and confirmed with his/her signature the fact that the child's health condition allows him/her to use the services provided by the Park.
3.19. Parents or other accompanying persons must ensure that children behave in a way that does not cause danger and harm to themselves and others.
3.20. The operator does not provide childcare services. The operator's employees generally supervise the order, but are not responsible for abandoned children.
Visitor's responsibility:
4.1. The Visitor is liable for any damage or loss caused by his/her actions or inaction to third parties, their property or health, or to the Operator. For damage caused by minors or disabled persons, their parents or guardians are liable.
4.2. Parents, guardians or other adults accompanying minors are responsible for familiarizing minors and persons with disabilities who arrive with them with the rules of the Amusement Park and for complying with these rules.
4.3. A Visitor who has suffered material and/or non-material damage in the Park must immediately report this to any Park employee, indicating the place, time and circumstances of the incident. If the Visitor fails to comply with this condition, any complaints submitted later will not be considered.
4.4. If the Visitor does not comply with the requirements specified in the Rules, the Operator has the right to prohibit such Visitor from visiting the Park for a limited or indefinite period, as well as to unilaterally terminate the Agreement.
4.5. A visitor who purchases a ticket and visits the Park in unsuitable weather conditions (strong wind, heavy rain or other weather elements) and suffers material and/or non-material damage assumes full responsibility for himself and the health of minors present with him.
4.6. A visitor who has lost their day-marking bracelet is not entitled to use the attractions in the Park.
Operator's responsibility:
5.1. The Operator is responsible for providing safe and high-quality entertainment in the Park.
5.2. The Operator does not assume liability for accidents or losses and does not consider Visitor claims arising from the Visitor's violation of the provisions of the Rules or legal acts, or the general duty to act with care and diligence.
5.3. The Operator is not responsible for any items of Visitors lost, misplaced or otherwise left unattended in the Park territory.
5.4. The Operator is not responsible for unsuitable weather conditions while in the Park and any health problems experienced as a result thereof.
5.5. The operator is not responsible for the safety of abandoned machines or property left in them.
5.6. If a visitor in the Park suffers material and/or non-material damage due to the fault of the operator, the Operator shall be liable in accordance with the procedure established by the laws of the Republic of Lithuania.
Recommendations for Visitors:
6.1. The Park Administration recommends that Visitors planning to enjoy themselves in the Park make sure that their health condition allows them to use the services provided in the Park.
6.2. Taking into account the variety of entertainment available in the Park, as well as the physical or mental condition of specific Visitors, certain entertainment may not be recommended for Visitors.
6.3. Visitors wearing any type of glasses are recommended to use the services provided in the Park only after attaching the laces to the glasses.
6.4. Recommendations related to the provision of specific services are set out in other sections of these Rules.
Final provisions:
7.1. The Operator or third parties engaged by him have the right to photograph, film or otherwise record the Visitor in the Park territory. All rights related to the recording belong to the Operator. The Operator has the right to use the recorded material free of charge for marketing or other lawful purposes. If the Visitor does not agree to this, he shall immediately inform the Park employee.
7.2. The Operator has the right to process the Visitor's personal data indicated in the list of persons who have familiarized themselves with the Rules.
7.3. Entertainment may not be organized due to unsuitable weather conditions or other circumstances. Persons who decide to visit the park territory in unsuitable weather conditions assume full responsibility for the inconveniences experienced. In such a case, money will not be refunded to Visitors.
7.4. By signing these Rules and using the services provided by the Park and the Operator, the Visitor agrees and voluntarily assumes full responsibility for his own safety and health and that of the persons under his care. The Visitor confirms that he is aware that improper use of the entertainment may pose a risk to his health and safety or that of the persons under his care and that such risk may be reduced or completely eliminated by his own or the persons under his care unconditional compliance with these Rules and general standards of safe conduct.
7.5. The number of parking spaces in the park is limited, therefore the event organizer is not responsible for parking or a possible shortage of spaces.
7.6. It is strictly forbidden to bring your own food and drinks into the park territory.
7.7. Filming and photography are done in the park territory for marketing purposes. By purchasing a park ticket, the customer agrees to all park rules.
